1. Agreement
These Terms of Use ("Terms") are a contract between you and APPFUSION LABS, LLC ("Bites", "we") for the Bites iOS app and its services. By installing or using Bites you accept these Terms and our Privacy Policy. If you do not agree, do not use the app. Apple's Licensed Application End User License Agreement also applies; where it conflicts with these Terms, these Terms prevail to the extent permitted.
2. Eligibility
You must be at least 13 years old to use Bites. Bites is designed for people aged 16 and over; if you are 13–15, use it with a parent or clinician. You are responsible for keeping your device secure.
3. Not medical advice
Bites provides general nutrition information and estimates. It is not medical advice, diagnosis or treatment, and it is not a substitute for a doctor, dietitian or other clinician. Calorie budgets, macronutrient targets, weight projections and AI estimates are approximations based on formulas and models that can be wrong. Do not use Bites to manage a medical condition, during pregnancy, or if you have a history of disordered eating without professional guidance. If you feel unwell, stop and seek medical help.
4. AI estimates and food data
Photo, description and label scans are analysed by an artificial-intelligence model. Estimates of portions and nutrition can be wrong, most often for mixed dishes, hidden oil and fat, and portion sizes. Every number is editable and you are responsible for checking and correcting entries. Food data comes from USDA FoodData Central (public domain), Open Food Facts (Open Database License) and our own curated set; we do not guarantee its accuracy or completeness, and packaged-food information may be out of date relative to the product in your hand.
The optional photo features are for adults (18 and over) and only for photos of yourself. Body insights give estimated ranges from a photo and can be wrong. Future look images are AI illustrations, not predictions: how your body actually changes depends on many things a photo cannot show.
5. Your content
You keep ownership of everything you enter: photos, descriptions, recipes, notes. You grant us a limited licence to process this content only to provide the service (for example to send a photo to the AI provider for analysis). Corrections and ratings you choose to send ("Something's off", meal ratings) may be used to improve recognition accuracy; they contain food names and amounts, not photos. Do not upload content that is unlawful or that you do not have the right to share.
6. Bites Pro subscription
- Everything in the app is currently free. Bites Pro is an optional auto-renewable subscription that supports the servers, the AI costs and human email support, and keeps the app independent and ad-free. Features that are free today may become part of Pro in a future version; we will say so clearly in the app and on the App Store before that happens, and anything you have logged always stays yours.
- Plans: Pro Yearly (with a 7-day free trial when you are eligible) and Pro Monthly (no trial). Prices are shown in the app in your local currency before you subscribe.
- Payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial. Any unused portion of a free trial is forfeited when you purchase a subscription.
- The subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it at any time in iOS Settings › Apple Account › Subscriptions; cancelling stops future renewals and keeps access until the end of the paid period.
- Bites sends one local reminder the day before a free trial converts to a paid subscription, if notifications are allowed.
- Purchases are handled by Apple. Refunds are governed by Apple's policies; you can request one at reportaproblem.apple.com, and we will help you with the request if you email us.
- Restore Purchases is available on the Pro screen.
7. Acceptable use
Do not reverse-engineer the app, abuse or overload our servers, use automated tools against the service, attempt to bypass fair-use limits, or use the service for anything unlawful. We may apply fair-use limits to AI scans to keep the service available for everyone.
8. Availability and changes
We work to keep the service available but do not guarantee uninterrupted operation; AI features depend on third-party providers and may be paused. We may change or discontinue features. Logging, search and your data on your device do not depend on our server.
9. Intellectual property
Bites, its design, illustrations, recipes and software are owned by APPFUSION LABS, LLC or its licensors and protected by copyright and other laws. We grant you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store terms. Food data attribution: USDA FoodData Central; Open Food Facts contributors, ODbL.
10. Disclaimer of warranties
To the maximum extent permitted by law, Bites is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of estimates.
11. Limitation of liability
To the maximum extent permitted by law, APPFUSION LABS, LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcome, or profits, arising from your use of Bites. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or USD 50 if you paid nothing. Some jurisdictions do not allow these limits; in that case they apply to the extent permitted.
12. Termination
You may stop using Bites at any time and delete your data from Settings. We may suspend or terminate access to the service if you breach these Terms. Sections 3, 4, 9, 10 and 11 survive termination.
13. Governing law
These Terms are governed by the laws of the United States and of the state in which APPFUSION LABS, LLC is organised, without regard to conflict-of-law rules, except where the mandatory consumer law of your country of residence gives you additional protection, which is not affected by these Terms.
14. Changes to these Terms
We may update these Terms. Material changes will be announced in the app or on this page with a new effective date; continued use after the change means you accept the new Terms.
